Unless otherwise provided by agreement or custom, the commission falls due at the end of the calendar half-year in which the transaction was concluded, whereas in insurance business the commission falls due when the first annual premium has been paid.
1 L’agent perd son droit à la provision dans la mesure où l’exécution d’une affaire conclue est empêchée par une cause non imputable au mandant.
2 Ce droit s’éteint en revanche si la contre-prestation correspondant à la prestation déjà effectuée par le mandant n’est pas accomplie ou l’est si peu que le paiement d’une provision ne saurait être exigé du mandant.
