220 Loi fédérale du 30 mars 1911 complétant le code civil suisse (Livre cinquième: Droit des obligations)

Art. 1087 a. In general

1 The form of a declaration on a bill of exchange is determined according to the law of the country in whose territory the declaration was signed.

2 However, where a declaration on a bill of exchange that is invalid under the previous paragraph would be valid under the law of the country in whose territory a subsequent declaration is signed, the validity of the later declaration is not affected by any formal defects of the earlier declaration.

3 Similarly, a declaration on a bill of exchange given by one Swiss national abroad is valid in relation to another Swiss national in Switzerland provided it satisfies the formal requirements laid down by Swiss law.

Art. 1084 2. Lieu où doivent se faire les actes relatifs à la lettre de change

1 La présentation à l’acceptation ou au paiement, le protêt, la demande de duplicata, ainsi que tous les autres actes à faire auprès d’une personne déterminée, doivent être faits dans ses bureaux ou, à défaut de bureaux, dans sa demeure.

2 Les bureaux ou la demeure seront l’objet de recherches diligentes.

3 Toutefois, ces recherches peuvent être abandonnées si les informations prises auprès de la police ou de l’office postal de la localité sont restées infructueuses.
