Art. 120 B. Marital property law and inheritance law

1 The provisions of marital property law apply to the division of marital property.

2 Divorced spouses have no statutory rights of inheritance in relation to each other.186

3 Unless there is an instruction to the contrary, spouses may not raise any claims based on testamentary dispositions:

1.
after divorce;
2.
after the death of a spouse during divorce proceedings that results in the surviving spouse losing his or her right to claim the statutory entitlement.187

Art. 119 A. Nom

L’époux qui a changé de nom lors de la conclusion du mariage conserve ce nom après le divorce; il peut toutefois déclarer en tout temps à l’officier de l’état civil vouloir reprendre son nom de célibataire.
