Art. 89a Duty to cooperate for recipients of subsidies

1 SEM may require the cantons to collect the data required for financial supervision, determining and adjusting the financial compensatory payments from the Confederation under Articles 88 and 91 paragraph 2bis of this Act and 58 and 87 FNIA247 and to make it available to SEM or record it in SEM's Central Migration Information System (ZEMIS).248

2 If a canton fails to comply with this requirement, SEM may reduce the financial compensatory payments made to this canton or determine the payments due on the basis of the data available.

Art. 89a Obligation de collaborer des bénéficiaires de subventions

1 Le SEM peut obliger les cantons à relever et à mettre à sa disposition, ou à saisir dans le système d’information central sur la migration (SYMIC), les données nécessaires à la surveillance financière ainsi qu’à la détermination et à l’adaptation des indemnités financières versées par la Confédération au titre des art. 88 et 91, al. 2bis, de la présente loi et des art. 58 et 87 LEI249.250

2 Le SEM peut réduire les indemnités financières du canton qui ne s’acquitte pas de cette obligation ou les fixer en se fondant sur les données disponibles.
