Art. 13 Supervision

1 Where the professional conduct of a patent attorney gives rise to complaints, the Swiss Federal Department of Justice and Police (FDJP) may, after hearing the person concerned:

a.
admonish him or her;
b.
authorise the IPI to disqualify him or her temporarily or permanently from using the professional title.

2 In assessing professional conduct within the meaning of paragraph 1, the patent attorney’s entire business activities in Switzerland and abroad shall be taken into consideration.

3 The FDJP may order the publication of the admonition or the disqualification as well as the deletion of the registration from the Patent Attorney Register.

Art. 13 Aufsicht

1 Gibt das Geschäftsgebaren einer Patentanwältin oder eines Patentanwalts zu Klagen Anlass, so kann das Eidgenössische Justiz- und Polizeidepartement (EJPD), nachdem es die Person angehört hat:

a.
sie verwarnen;
b.
das IGE ermächtigen, sie zeitweilig oder für immer als Patentanwältin oder Patentanwalt auszuschliessen.

2 Für die Beurteilung des Geschäftsgebarens im Sinne von Absatz 1 fällt die gesamte Geschäftstätigkeit der Patenanwältin oder des Patentanwalts im In- und Ausland in Betracht.

3 Das EJPD kann die Veröffentlichung der Verwarnung oder des Ausschlusses sowie die Löschung des Eintrags im Patentanwaltsregister anordnen.
