1 Anyone who commercially supplies a substance or preparation in Group 1 to professional users or traders must, at the time of supply, explicitly inform them of the precautions required and the correct method of disposal.
2 Anyone who commercially supplies a substance or preparation in Group 2 to private users must, at the time of supply, explicitly inform them of the precautions required and the correct method of disposal.
3 Substances and preparations may be supplied in accordance with paragraph 2 only to persons who can be assumed by the supplier to be capable of judgement and able to comply with the duty of care specified in Article 8 of the Chemicals Act and the requirements set out in Article 28 of the EPA.
4 The obligations specified in paragraphs 1 and 2 do not apply to the supply of motor fuels.
1 Wer einen Stoff oder eine Zubereitung der Gruppe 1 gewerblich an berufliche Verwenderinnen oder an Händlerinnen abgibt, muss diese bei der Abgabe ausdrücklich über die erforderlichen Schutzmassnahmen und die vorschriftsgemässe Entsorgung informieren.
2 Wer einen Stoff oder eine Zubereitung der Gruppe 2 gewerblich an private Verwenderinnen abgibt, muss diese bei der Abgabe ausdrücklich über die erforderlichen Schutzmassnahmen und die vorschriftsgemässe Entsorgung informieren.
3 Stoffe und Zubereitungen dürfen nach Absatz 2 nur an Personen abgegeben werden, von denen die Abgeberin annehmen kann, dass sie urteilsfähig sind und die Sorgfaltspflicht nach Artikel 8 ChemG sowie die Anforderungen nach Artikel 28 USG einhalten können.
4 Die Pflichten nach den Absätzen 1 und 2 gelten nicht für die Abgabe von Motorkraftstoff.
