1 Research projects as defined in Chapter 2 which were granted authorisation before 1 January 2014 are considered to be Category B research projects.
2 On request, the authority which authorised the research project before 1 January 2014 may assign the research project to Category A. In this case, the liability, coverage and notification requirements are governed by the new law.
3 The ethics committee shall make the decision specified in paragraph 2 according to the simplified procedure specified in Article 6 of the HRA Organisation Ordinance of 20 September 201311.
4 The provisions of this Ordinance are applicable:
5 The responsible ethics committee shall make a decision on applications concerning research projects not subject to authorisation under existing law, submitted in accordance with Article 67 paragraph 2 HRA, within six months after acknowledgement of receipt of the formally correct application documents.
1 Forschungsprojekte nach dem 2. Kapitel, die vor dem 1. Januar 2014 bewilligt wurden, gelten als Forschungsprojekte der Kategorie B.
2 Auf Gesuch hin kann die Behörde, die das Forschungsprojekt vor dem 1. Januar 2014 bewilligt hat, das Forschungsprojekt in die Kategorie A einteilen. Diesfalls richten sich die Haftungs-, Sicherstellungs- und Meldepflichten nach neuem Recht.
3 Die Ethikkommission trifft den Entscheid nach Absatz 2 im vereinfachten Verfahren nach Artikel 6 der Organisationsverordnung HFG vom 20. September 201311.
4 Die Bestimmungen dieser Verordnung sind anwendbar:
5 Die zuständige Ethikkommission entscheidet über Gesuche für nach bisherigem Recht nicht bewilligungspflichtige Forschungsprojekte im Sinn von Artikel 67 Absatz 2 HFG innerhalb von sechs Monaten nach der Bestätigung des Eingangs der formal korrekten Gesuchsunterlagen.
