Art. 85 Compensation for cantonal sovereignty

1 In the event that cantonal sovereignty should be affected as the result of geological investigations in accordance with Article 35, deep geological repositories or protection zones, the licence holder shall compensate the canton concerned in full.

2 Full compensation in accordance with paragraph 1 above shall also be paid if claims are made on cantonal water rights as the result of the construction of a nuclear power plant.

3 If no agreement can be reached on compensation, the compensation shall be determined by the Compulsory Purchase Tribunal in accordance with Article 64 of the CPA44.45

Art. 84 Gebühren der Kantone

Die Kantone können von den Inhabern von Kernanlagen, nuklearen Gütern und radioaktiven Abfällen Gebühren und den Ersatz von Auslagen verlangen insbesondere für:

a.
Planung und Durchführung von Notfallschutzmassnahmen;
b.
den polizeilichen Schutz der Kernanlagen und des Transportes von Kernmaterialien und radioaktiven Abfällen;
c.
die Ausbildung der Betriebswache;
d.
die Vermessung der Grundstücke im Schutzbereich, ihre Aufnahme ins Grundbuch und die Grundbucheinträge.
