1 The FOEN shall calculate the quantity of emission allowances available for allocation free of charge to aircraft operators in accordance with Annex 15 Sections 6 and 7. The allocation is made only if the aircraft operators have submitted a tonne-kilometre monitoring report in accordance with the Ordinance of 2 June 2017146 on the acquisition of tonne-kilometre data and the drawing-up of monitoring plans for flight routes.147

3 If an aircraft operator that is allocated emission allowances free of charge does not perform any flights in a particular year in accordance with Annex 13, it must surrender to the FOEN the emission allowances allocated free of charge for this year by 30 November of the following year. The returned emission allowances are cancelled.149
4 Emission allowances which cannot be allocated free of charge are cancelled.

1 Das BAFU berechnet die Menge der Emissionsrechte, die einem Luftfahrzeugbetreiber kostenlos zuzuteilen sind, nach Anhang 15 Ziffern 6 und 7. Die Zuteilung erfolgt nur, wenn der Luftfahrzeugbetreiber einen Tonnenkilometer-Monitoringbericht nach der Verordnung vom 2. 3 Führt ein Luftfahrzeugbetreiber, dem kostenlos Emissionsrechte zugeteilt worden sind, in einem bestimmten Jahr keine Flüge nach Anhang 13 durch, muss er die für dieses Jahr kostenlos zugeteilten Emissionsrechte bis zum 30. November des Folgejahres an das BAFU zurückgeben. Die zurückgegebenen Emissionsrechte werden gelöscht.149
4 Emissionsrechte, die nicht kostenlos zugeteilt werden können, werden gelöscht.
