1 An installation operator that participates for the first time in the ETS after 1 January 2021 shall receive an allocation of emission allowances free of charge from the reserve in accordance with Article 45 paragraph 2 from the start of its participation in the ETS.
2 If an operator already participating in the ETS brings an additional unit decisive for emission allowances to be allocated free of charge (a sub-installation) into operation, it shall be allocated emission allowances free of charge from the portion mentioned in Article 45 paragraph 2 from the start of operations.
3 Emission allowances are allocated free of charge in accordance with Article 46 and 46b.

1 Ein Betreiber von Anlagen, der ab dem 2. Januar 2021 neu am EHS teilnimmt, erhält ab dem Zeitpunkt der Teilnahme am EHS Emissionsrechte aus dem Anteil nach Artikel 45 Absatz 2 kostenlos zugeteilt.
2 Nimmt ein Betreiber, der bereits am EHS teilnimmt, eine zusätzliche Einheit in Betrieb, die für die kostenlose Zuteilung von Emissionsrechten massgeblich ist (Zuteilungselement), so werden ihm ab dem Zeitpunkt von deren Inbetriebnahme Emissionsrechte aus dem Anteil nach Artikel 45 Absatz 2 kostenlos zugeteilt.
3 Die kostenlose Zuteilung von Emissionsrechten richtet sich nach den Artikeln 46 und 46b.
