Art. 187

1 The arbitral tribunal shall decide the dispute according to the rules of law chosen by the parties or, in the absence of such a choice, according to the rules of law with which the case has the closest connection.156

2 The parties may authorise the arbitral tribunal to decide ex aequo et bono.

Art. 185a

1 Ein Schiedsgericht mit Sitz im Ausland oder eine Partei eines ausländischen Schiedsverfahrens kann das staatliche Gericht am Ort, an dem eine vorsorgliche oder sichernde Massnahme vollstreckt werden soll, um Mitwirkung ersuchen. Artikel 183 Absätze 2 und 3 gilt sinngemäss.

2 Ein Schiedsgericht mit Sitz im Ausland oder eine Partei eines ausländischen Schiedsverfahrens mit Zustimmung des Schiedsgerichts kann das staatliche Gericht am Ort, an dem die Beweisaufnahme erfolgen soll, um Mitwirkung ersuchen. Artikel 184 Absätze 2 und 3 gilt sinngemäss.
