Art. 114

1 An action by a consumer relating to a contract which meets the requirements stated in Article 120 paragraph 1 may be brought at the consumer’s choice before the Swiss courts:

a.
at their domicile or habitual residence; or
b.
at the domicile or, in the absence of a domicile, at the habitual residence of the supplier.

2 A consumer cannot waive in advance jurisdiction at their domicile or habitual residence.

Art. 114

1 Für die Klagen eines Konsumenten aus einem Vertrag, der den Voraussetzungen von Artikel 120 Absatz 1 entspricht, sind nach Wahl des Konsumenten die schweizerischen Gerichte zuständig:

a.
am Wohnsitz oder am gewöhnlichen Aufenthalt des Konsumenten, oder
b.
am Wohnsitz des Anbieters oder, wenn ein solcher fehlt, an dessen gewöhnlichem Aufenthalt.

2 Der Konsument kann nicht zum voraus auf den Gerichtsstand an seinem Wohnsitz oder an seinem gewöhnlichen Aufenthalt verzichten.
