Art. 27

1 Where a ground for nullity applies to only a part of the patented invention, the court shall limit the patent accordingly.

2 The court shall give the parties an opportunity to be heard on the proposed new version of the patent claim; it may also request the opinion of the IPI.

3 Article 25 applies by analogy.

Art. 27

1 Trifft ein Nichtigkeitsgrund nur für einen Teil der patentierten Erfindung zu, so ist das Patent durch den Richter entsprechend einzuschränken.

2 Der Richter hat den Parteien Gelegenheit zu geben, sich zu der von ihm in Aussicht genommenen Neufassung des Patentanspruches zu äussern; er kann überdies die Vernehmlassung des IGE einholen.

3 Artikel 25 ist entsprechend anwendbar.
