1 If the FOCBS, as a result of an application under Article 71 paragraph 1, has reasonable grounds to suspect that certain goods intended to be transported into or out of the customs territory of Switzerland unlawfully bear a trade mark or indication of source, then it shall notify the applicant and the declarant, holder or owner of the goods accordingly.103
2 It shall withhold the goods for a maximum of ten working days from the time of notification pursuant to paragraph 1, so that the applicant may obtain preliminary measures.
3 Where justified by circumstances, it may withhold the goods for a maximum of ten additional working days.

1 Hat das BAZG aufgrund eines Antrags nach Artikel 71 Absatz 1 den begründeten Verdacht, dass eine zum Verbringen ins schweizerische Zollgebiet oder aus dem schweizerischen Zollgebiet bestimmte Ware widerrechtlich mit einer Marke oder einer Herkunftsangabe versehen ist, so teilt es dies einerseits dem Antragsteller und andererseits dem Anmelder, Besitzer oder Eigentümer der Ware mit.103
2 Es behält die Ware bis höchstens zehn Werktage vom Zeitpunkt der Mitteilung nach Absatz 1 an zurück, damit der Antragsteller vorsorgliche Massnahmen erwirken kann.
3 In begründeten Fällen kann sie die Ware während höchstens zehn weiteren Werktagen zurückbehalten.
