1 If the proprietor of the trade mark, the licensee entitled to institute proceedings, the person entitled to use an indication of source or a party entitled to institute proceedings under Article 56 has clear indications of the imminent transport of goods that unlawfully bear a trade mark or an indication of source into or out of the customs territory of Switzerland, he or she may request the FOCBS in writing to refuse the release of the goods.101
2 The applicant must provide all the information available to him that is necessary for the FOCBS’s decision; this includes a precise description of the goods.
3 The FOCBS shall make the final decision on the application. It may charge a fee to cover the administrative costs.

1 Hat der Markeninhaber, der klageberechtigte Lizenznehmer, der an einer Herkunftsangabe Berechtigte oder eine nach Artikel 56 klageberechtigte Partei konkrete Anhaltspunkte dafür, dass das Verbringen von widerrechtlich mit einer Marke oder einer Herkunftsangabe versehenen Waren ins schweizerische Zollgebiet oder aus dem schweizerischen Zollgebiet bevorsteht, so kann er oder sie dem BAZG schriftlich beantragen, die Freigabe der Waren zu verweigern.101
2 Der Antragsteller muss alle ihm zur Verfügung stehenden Angaben machen, die für den Entscheid des BAZG erforderlich sind; dazu gehört eine genaue Beschreibung der Waren.
3 Das BAZG entscheidet über den Antrag endgültig. Es kann eine Gebühr zur Deckung der Verwaltungskosten erheben.
