1 If it is anticipated that withholding the goods may lead to a loss being incurred, the FOCBS may make the withholding of the goods dependent on the applicant providing them with an accountability statement. As an alternative to this statement and where justified by the circumstances, the FOCBS may request the applicant to provide appropriate security.
2 The applicant is liable for any losses incurred from withholding the goods and from collecting the samples if preliminary measures are not ordered or prove to be unjustified.

1 Ist durch das Zurückbehalten der Ware ein Schaden zu befürchten, so kann das BAZG das Zurückbehalten davon abhängig machen, dass der Antragsteller oder die Antragstellerin ihm eine Haftungserklärung abgibt. An deren Stelle kann das BAZG vom Antragsteller oder von der Antragstellerin in begründeten Fällen eine angemessene Sicherheitsleistung verlangen.
2 Der Antragsteller oder die Antragstellerin muss den Schaden, der durch das Zurückbehalten der Ware und die Entnahme von Proben oder Mustern entstanden ist, ersetzen, wenn vorsorgliche Massnahmen nicht angeordnet werden oder sich als unbegründet erweisen.
