1 When making an application under Article 76 paragraph 1, the applicant may submit a written request for the FOCBS to destroy the goods.
2 If an application for destruction is made, the FOCBS shall notify the declarant, holder or owner of the goods accordingly as part of the notification made under Article 77 paragraph 1.
3 The application for destruction does not result in the time limits for obtaining preliminary measures under Article 77 paragraphs 2 and 3 being extended.

1 Zusammen mit dem Antrag nach Artikel 76 Absatz 1 kann der Antragsteller oder die Antragstellerin beim BAZG schriftlich beantragen, die Ware zu vernichten.
2 Wird ein Antrag auf Vernichtung gestellt, so teilt das BAZG dies dem Anmelder, Besitzer oder Eigentümer beziehungsweise der Anmelderin, Besitzerin oder Eigentümerin der Ware im Rahmen der Mitteilung nach Artikel 77 Absatz 1 mit.
3 Der Antrag auf Vernichtung führt nicht dazu, dass die Fristen nach Artikel 77 Absätze 2 und 3 zur Erwirkung vorsorglicher Massnahmen verlängert werden.
