Art. 40

1 The following are subject to federal supervision:

a.
the management of exclusive rights for the performance and broadcasting of non-theatrical works of music and the production of phonograms and audio-visual fixations of such works;
abis.46
the assertion of exclusive rights under Articles 22, 22a–22c and 24b;
b.47
the assertion of rights to remuneration provided for in this Act under Articles 13, 13a, 20, 24c, 35 and 35a.

2 The Federal Council may subject other areas of collective rights management to federal supervision if public interest so requires.

3 The personal exploitation of exclusive rights under paragraph 1 letter a by the author or his heirs is not subject to federal supervision.

Art. 40

1 Der Bundesaufsicht sind unterstellt:

a.
die Verwertung der ausschliesslichen Rechte zur Aufführung und Sendung nichttheatralischer Werke der Musik und zur Herstellung von Tonträgern oder Tonbildträgern solcher Werke;
abis.46
das Geltendmachen von ausschliesslichen Rechten nach den Artikeln 22, 22a−22c und 24b;
b.47
das Geltendmachen der Vergütungsansprüche nach den Artikeln 13, 13a, 20, 24c, 35 und 35a.

2 Der Bundesrat kann weitere Verwertungsbereiche der Bundesaufsicht unterstellen, wenn es das öffentliche Interesse erfordert.

3 Die persönliche Verwertung der ausschliesslichen Rechte nach Absatz 1 Buchstabe a durch den Urheber oder die Urheberin oder deren Erben ist nicht der Bundesaufsicht unterstellt.
