Art. 4 Begleitunterlagen

¹ Die Begleitunterlagen für gentechnisch veränderte Organismen für den Umgang in der Umwelt müssen folgende Angaben enthalten:

a.: einen eindeutigen Hinweis, dass es sich um gentechnisch veränderte Organismen handelt;
b.: den Erkennungsmarker nach dem Anhang der Verordnung (EG) Nr. 65/2004 der Kommission vom 14. Januar 2004⁸ über ein System für die Entwicklung und Zuweisung spezifischer Erkennungsmarker für genetisch veränderte Organismen oder, wenn ein solcher fehlt, die Identität der Organismen unter Angabe der wesentlichen Eigenschaften und Merkmale;
c.: Anweisungen für die sichere Handhabung, Lagerung, Beförderung und Verwendung der Organismen;
d.: Name und Adresse der Person, bei der weitere Informationen verlangt werden können;
e.: Name und Adresse der Empfängerin oder des Empfängers;
f.: eine Erklärung, dass der grenzüberschreitende Verkehr den Vorschriften für Exporteure nach dem Protokoll von Cartagena entspricht.

² Für gentechnisch veränderte Organismen, die zur Verarbeitung sowie zur unmittelbaren Verwendung als Lebens‑, Futter‑ oder als Tierarzneimittel vorgesehen sind, muss der Hinweis nach Absatz 1 Buchstabe a zusätzlich festhalten, dass es sich um gentechnisch veränderte Organismen handelt, die nicht direkt in die Umwelt ausgebracht werden dürfen.

³ Für gentechnisch veränderte Organismen, die im geschlossenen System verwendet werden sollen, gilt Absatz 1 Buchstaben a–e.

Art. 4 Accompanying documentation

¹The documentation accompanying the transboundary movements of genetically modified organisms for handling in the environment must contain the following information:

a.: a clear indication that the goods in question are genetically modified organisms;
b.: the unique identifier in accordance with the Annex to the Regulation (EC) No 65/2004 of the European Commission of 14 January 2004⁸ establishing a system for the development and assignment of unique identifiers for genetically modified organisms or, in the absence of this identifier, specification of the identity of the organisms with the relevant properties and characteristics;
c.: instructions on the safe handling, storage, transport and use of the organisms;
d.: the name and address of a person to contact for any additional information that might be required;
e.: the name and address of the recipient;
f.: a declaration certifying that the movement conforms to the provisions of the Cartagena Protocol as these apply to the exporter.

²If genetically modified organisms are to be processed for use or to be used directly as foodstuffs for humans or animals or as veterinary medicines, the indication in accordance with paragraph 1 letter a above must also specify that the genetically modified organisms in question may not under any circumstances be introduced directly into the environment.

³If the genetically modified organisms are intended for use in a contained system, only the requirements of paragraph 1 letters a-e above apply.
