Art. 106 Freimessung und andere Methoden zur Befreiung

1 Die Bewilligungsinhaberin oder der Bewilligungsinhaber kann den Umgang mit Material von der Bewilligungspflicht und der Aufsicht befreien, wenn sie oder er durch eine Messung nachweist (Freimessung), dass:

a.
die maximale Ortsdosisleistung im Abstand von 10 cm von der Oberfläche nach Abzug der natürlichen Strahlung unter 0,1 µSv/h liegt; und
b.
eine der folgenden Voraussetzungen erfüllt ist:
1.
die spezifische Aktivität liegt unter der Befreiungsgrenze,
2.
die absolute Aktivität ist kleiner als die Aktivität von 1 kg eines Materials, dessen spezifische Aktivität der Befreiungsgrenze entspricht.

2 Falls sich Personen bei der Handhabung von freigemessenem Material nach Absatz 1 kontaminieren können, muss zusätzlich durch eine Messung sichergestellt werden, dass der Richtwert für Oberflächenkontamination nach Anhang 3 Spalte 12 eingehalten wird.

3 Für die Mittelung der nach den Absätzen 1 und 2 gemessenen Werte zur Sicherstellung der Unterschreitung der Befreiungsgrenze oder der Richtwerte für Oberflächenkontamination nach Anhang 3 Spalte 12 sind folgende Grössen einzuhalten:

a.
für die Messung der Aktivität: 100 kg;
b.
für die Messung der Oberflächenkontamination: 100 cm2.

4 Die Aufsichtsbehörde kann in begründeten Fällen höheren Werten als den in Absatz 3 festgelegten zustimmen.

5 Der Umgang mit festem oder flüssigem Material kann ohne messtechnische Bestimmung der Aktivität befreit werden, wenn:

a.
die maximale Ortsdosisleistung im Abstand von 10 cm von der Oberfläche nach Abzug der natürlichen Strahlung unter 0,1 µSv/h liegt;
b.
Absatz 2 eingehalten ist; und
c.
eine der folgenden Voraussetzungen erfüllt ist:
1.
die Unterschreitung der Befreiungsgrenze kann durch eine Bilanzierung der eingesetzten Materialien oder durch den Ausschluss einer Aktivierung nachgewiesen werden,
2.
die Aufsichtsbehörde hat den Modellen und Berechnungen zum Nachweis der Unterschreitung der Befreiungsgrenze zugestimmt.

6 Die Aufsichtsbehörde kann die Voraussetzungen festlegen, unter denen ihr die Resultate einer Freimessung vor der Befreiung der Materialien zu melden sind.

Art. 106 Clearance measurement and other clearance methods

1 Licence holders may clear the handling of material from mandatory licensing and supervision if they demonstrate by a measurement (clearance measurement) that:

a.
the maximum ambient dose rate at a distance of 10 cm from the surface, allowing for natural radiation, is less than 0.1 µSv per hour; and
b.
one of the following requirements is met:
1.
the specific activity is below the clearance limit,
2.
the absolute activity is less than the activity of 1 kg of a material whose specific activity is equal to the clearance limit.

2 If persons may be contaminated when handling material cleared in accordance with paragraph 1, it must additionally be ensured by a measurement that the surface contamination guidance value specified in Annex 3 Column 12 is complied with.

3 For the averaging of the values measured in accordance with paragraphs 1 and 2 to ensure non-exceedance of the clearance limit or the surface contamination guidance values specified in Annex 3 Column 12, the following quantities must be complied with:

a.
for the measurement of activity: 100 kg;
b.
for the measurement of surface contamination: 100 cm2.

4 In justified cases, the supervisory authority may approve values higher than those specified in paragraph 3.

5 Handling of solid or liquid material may be cleared without measurement of activity by technical means if:

a.
the maximum ambient dose rate at a distance of 10 cm from the surface, allowing for natural radiation, is less than 0.1 µSv per hour;
b.
paragraph 2 is complied with; and
c.
one of the following requirements is met:
1.
it can be demonstrated that the clearance limit is not exceeded by an assessment of the materials used or by excluding activation,
2.
the supervisory authority has approved the models and calculations used to demonstrate that the clearance limit is not exceeded.

6 The supervisory authority may define the conditions under which the results of a clearance measurement must be reported to it prior to the clearance of the materials.
