814.021 Ordinance of 12 May 2021 on Placing Timber and Wood Products on the Market (Timber Trade Ordinance, TTO)
Art. 5 Beschaffung von Informationen und Dokumentation
1 Die Erstinverkehrbringer müssen folgende Informationen beschaffen:
- a.
- Beschreibung des Holzes oder des Holzerzeugnisses, einschliesslich des Handelsnamens und der Produktart sowie des gängigen Namens der Baumart und des vollständigen wissenschaftlichen Namens;
- b.
- das Ursprungsland;
- c.
- die Region, sofern das Risiko des illegalen Holzeinschlages nicht für jede Region eines Ursprungslandes als gleich hoch eingestuft wird;
- d.
- Angaben zur Konzession für den Holzeinschlag, sofern das Risiko des illegalen Holzeinschlages nicht für jede Konzession eines Ursprungslandes oder einer Region als gleich hoch eingestuft wird;
- e.
- die Menge des Holzes und der Holzerzeugnisse in Volumen, Gewicht oder Anzahl Produkteinheiten;
- f.
- Name und Adresse des Zulieferers;
- g.
- Nachweise, dass die einschlägigen Rechtsvorschriften des Ursprungslands eingehalten wurden; dabei gelten Holz und Holzerzeugnisse, für deren Ein-, Durch- und Ausfuhr eine Bewilligung nach Artikel 8 Absätze 1, 2 oder 4 und Artikel 12 der Verordnung vom 4. September 20132 über den Verkehr mit Tieren und Pflanzen geschützter Arten erteilt wurde, als legal geschlagen.
2 Sie müssen dokumentieren, an wen sie das Holz oder die Holzerzeugnisse weitergegeben haben.
Art. 5 Gathering of information and documentation
1 Initial operators must gather the following information:
- a.
- description of the timber or wood product, including the trade name and type of product as well as the common name of the tree species and its full scientific name;
- b.
- the country of origin;
- c.
- the region, unless the risk of illegal harvesting is regarded as equally high in every region of a country of origin;
- d.
- information on the harvesting concession unless the risk of illegal harvesting is regarded as equally high in the case of every concession granted in a country of origin or a region;
- e.
- the quantity of timber and wood products in volume or weight or in number of units;
- f.
- the name and address of the supplier;
- g.
- information indicating compliance with the applicable legislation in the country of origin; timber and wood products for whose import, transit and export a permit has been issued under Article 8 paragraphs 1, 2 or 4 and Article 12 of the Ordinance of 4 September 20132 on the Trade in Protected Animal and Plant Species are deemed to have been legally harvested.
- 2 They must document to whom they passed on the timber or wood products.
