1 Der Bundesrat ernennt die erste Direktorin oder den ersten Direktor des Instituts auf Antrag des Eidgenössischen Departements des Innern.
2 Das Eidgenössische Departement des Innern bestimmt erstmals die weiteren Mitglieder der Direktion. Sie sind durch den Institutsrat gemäss Artikel 72 Buchstabe h spätestens 18 Monate nach Betriebsaufnahme des Instituts zu bestätigen.
3 Die Dienstverhältnisse des vom BAG265 und von der Interkantonalen Kontrollstelle für Heilmittel in das Institut übertretenden Personals werden auf den Zeitpunkt der Betriebsaufnahme des Instituts dem Personalrecht des Instituts unterstellt.

1 The Federal Council shall appoint the first executive director of the Agency on the proposal of the Federal Department of Home Affairs.
2 The Federal Department of Home Affairs shall carry out the first appointment of the other members of the management. Their appointment shall be ratified by the Agency Council in accordance with Article 72 paragraph 1 letter h within 18 months of the Agency commencing its activity.
3 The contract service conditions of the staff transferred to the Agency from the FOPH265 and the Intercantonal Office for the Control of Medicinal Products shall be subject to the conditions of employment of the Agency from the time it commences its activity.
