Art. 15 Gesuch

Für die Bewilligung zur Ausfuhr embryonaler Stammzellen (Art. 15 des Gesetzes) sind dem Bundesamt folgende Unterlagen zur Prüfung einzureichen:

a.

Bezeichnung, Ziel und Durchführungsort des Forschungsprojekts mit embryonalen Stammzellen;

b.

Name und Adresse der Projektleitung;

c.

die Anzahl auszuführender embryonaler Stammzellen bzw. Stammzelllinien und deren Charakterisierung nach Artikel 29 Absatz 1 Buchstabe b;

d.

der Nachweis der nach dem Landesrecht des betreffenden Staates zuständigen oder von diesem anerkannten Stelle, dass:

1.: mit dem Projekt wesentliche Erkenntnisse im Hinblick auf die Feststellung, Behandlung oder Verhinderung schwerer Krankheiten oder über die Entwicklungsbiologie des Menschen erlangt werden sollen, und
2.: eine von der Projektleitung unabhängige Stelle das Projekt in ethischer Hinsicht befürwortet hat.

Art. 15 Application

When a licence is sought for the export of embryonic stem cells (Art. 15 of the Act), the following documents must be submitted to the Federal Office for review:

a.

the title, objective and place of execution of the research project involving embryonic stem cells;

b.

the name and address of the project manager;

c.

the number of embryonic stem cells or stem cell lines to be exported and a characterisation thereof, as specified in Article 29 paragraph 1 letter b;

d.

evidence provided by the authority designated as competent under national legislation in the country concerned or recognised by that country, to the effect that:

1.: the project is designed to yield important findings with regard to the detection, treatment or prevention of serious human diseases or concerning human developmental biology, and
2.: the project has received ethical approval from an authority independent of the project manager.
