Art. 13 Gesuch

Für die Bewilligung zur Einfuhr embryonaler Stammzellen (Art. 15 des Gesetzes) sind dem Bundesamt folgende Unterlagen zur Prüfung einzureichen:

a.

die vollständige Dokumentation des Forschungsprojekts mit embryonalen Stammzellen, wie sie nach Artikel 17 bei der zuständigen Ethikkommission eingereicht wurde;

b.

die befürwortende Stellungnahme der zuständigen Ethikkommission zum Forschungsprojekt;

c.

die Anzahl benötigter embryonaler Stammzellen bzw. Stammzelllinien und deren Charakterisierung nach Artikel 29 Absatz 1 Buchstabe b;

d.

der Nachweis der nach dem Landesrecht des betreffenden Staates zuständigen oder von diesem anerkannten Stelle, dass:

1.: die Stammzellen aus überzähligen Embryonen gewonnen worden sind,
2.: das betroffene Paar nach Aufklärung frei in die Verwendung des Embryos zu Forschungszwecken eingewilligt hat, und
3.: das betroffene Paar dafür kein Entgelt erhält.

Art. 13 Application

When a licence is sought for the import of embryonic stem cells (Art. 15 of the Act), the following documents must be submitted to the Federal Office for review:

a.

complete documentation for the research project involving embryonic stem cells, as submitted to the competent ethics committee in accordance with Article 17;

b.

the approval of the research project granted by the competent ethics committee;

c.

details of the number of embryonic stem cells or stem cell lines required and a characterisation thereof, as specified in Article 29 paragraph 1 letter b;

d.

evidence provided by the authority designated as competent under national legislation in the country concerned or recognised by that country to the effect that:

1.: the stem cells have been derived from surplus embryos,
2.: the couple concerned have freely given informed consent to the use of the embryo for research purposes, and
3.: the couple concerned are receiving no payment in return.
