810.21 Federal Act of 8 October 2004 on the Transplantation of Organs, Tissues and Cells (Transplantation Act)
Art. 37 Grundsatz und Verbote
1 Zeitpunkt und Methode eines Schwangerschaftsabbruchs müssen unabhängig von einer späteren Transplantation embryonaler oder fötaler menschlicher Gewebe oder Zellen gewählt werden.
2 Es ist verboten:
- a.
- überzählige Embryonen nach dem siebten Tag ihrer Entwicklung oder abortierte Embryonen oder Föten als Ganzes künstlich am Leben zu erhalten, um ihnen Gewebe oder Zellen zu Transplantationszwecken zu entnehmen;
- b.
- embryonale oder fötale Gewebe oder Zellen einer Person zu transplantieren, die von der Spenderin dafür bezeichnet worden ist;
- c.
- embryonale oder fötale Gewebe oder Zellen von urteilsunfähigen Frauen zu Transplantationszwecken zu verwenden.
Art. 37 Principles and prohibitions
1 The time and method of a termination of pregnancy must be selected independently of subsequent transplantation of embryonic or foetal human tissues or cells.
2 It is prohibited:
- a.
- to keep superfluous embryos alive artificially after the seventh day of development or to keep aborted embryos or intact foetuses alive artificially for the purpose of remove tissues or cells from them for transplantation;
- b.
- to transplant embryonic or foetal tissues or cells into a person designated for this purpose by the donor;
- c.
- to use embryonic or foetal tissues or cells from women who are incapable of judgement for transplantation purposes.
