1 Bestehen Anhaltspunkte für eine unzulässige Wettbewerbsbeschränkung, so eröffnet das Sekretariat im Einvernehmen mit einem Mitglied des Präsidiums eine Untersuchung. Eine Untersuchung wird in jedem Fall eröffnet, wenn das Sekretariat von der Wettbewerbskommission oder vom WBF damit beauftragt wird.28
2 Die Wettbewerbskommission entscheidet, welche der eröffneten Untersuchungen vorrangig zu behandeln sind.

1 If there are indications of an unlawful restraint of competition, the Secretariat shall, in consultation with a member of the presiding body, open an investigation. It shall in any event open an investigation whenever asked to do so by the Competition Commission or by the EAER.28
