Art. 24a Form und Inhalt des Antrags

Der Antrag auf Löschung einer Markeneintragung wegen Nichtgebrauchs der Marke ist in zwei Exemplaren einzureichen und muss enthalten:

a.: den Namen und Vornamen oder die Firma, die Adresse des Antragstellers und gegebenenfalls sein Zustellungsdomizil in der Schweiz;
b.: die Registernummer der Markeneintragung, deren Löschung beantragt wird, sowie den Namen oder die Firma des Markeninhabers;
c.: die Erklärung, in welchem Umfang die Löschung beantragt wird;
d.: eine Begründung des Antrags auf Löschung, die insbesondere den Nichtgebrauch glaubhaft macht;
e.: Beweismittel.

Art. 24a Form and content of the request

The request for cancellation of a trade mark registration on the grounds of non-use of the trade mark must be submitted in two copies and must include:

a.: the surname and first name or the company name, the address of the applicant and, where applicable, their address for service in Switzerland;
b.: the number of the trade mark registration for which a cancellation is requested, as well as the name or company of the proprietor of the trade mark;
c.: a declaration of the extent of the cancellation;
d.: an explanation of the request for cancellation which, in particular, substantiates the claim of non-use;
e.: evidence.
