Art. 111 Informationssysteme für Reisedokumente

¹ Das SEM führt ein Informationssystem zur Ausstellung von schweizerischen Reisedokumenten und Bewilligungen zur Wiedereinreise an Ausländerinnen und Ausländer (ISR).⁴⁰⁶

² Das ISR enthält folgende Daten:

a.⁴⁰⁷: Name, Vornamen, Geschlecht, Geburtsdatum, Geburtsort, Staatsangehörigkeit, Adresse, Grösse, Gesichtsbild, Fingerabdrücke, Name und Vornamen der Eltern, Ledigname der Eltern, Unterschrift, Dossiernummer sowie Personennummer;
b.: Angaben zum Gesuch, wie Gesuchseingang und Gesuchsentscheid;
c.: Angaben zum Reisedokument, wie Ausstellungsdatum und Gültigkeitsdauer;
d.: die Unterschriften und Namen der gesetzlichen Vertretung bei Reisedokumenten für minderjährige oder für entmündigte Personen;
e.: den Allianz-, Ordens- oder Künstlernamen sowie Angaben über besondere Kennzeichen wie Behinderungen, Prothesen oder Implantate, falls die antragstellende Person verlangt, dass das Reisedokument diese Angaben enthalten soll;
f.: Angaben zu den verlorenen Reisedokumenten.

³ Zur Prüfung, ob die gesuchstellende Person wegen eines Verbrechens oder Vergehens ausgeschrieben ist, erfolgt eine automatische Abfrage im automatisierten Polizeifahndungssystem RIPOL.⁴⁰⁸

⁴ Die gestützt auf Absatz 2 erfassten Daten werden von Mitarbeiterinnen und Mitarbeitern des SEM, die mit der Ausstellung von schweizerischen Reisedokumenten und Bewilligungen zur Wiedereinreise befasst sind, bearbeitet.⁴⁰⁹

⁵ Das SEM kann die gestützt auf Absatz 2 erfassten Daten folgenden Behörden oder Stellen durch ein Abrufverfahren zugänglich machen, soweit diese die Daten zur Erfüllung ihrer Aufgaben benötigen:⁴¹⁰

a.: der mit der Ausfertigung der Reisedokumente beauftragten Stelle;
b.: den Grenzposten der Polizeibehörden der Kantone und dem Grenzwachtkorps, für die Durchführung der Personenkontrolle;
c.: den von den Kantonen bezeichneten Polizeistellen, zur Identitätsabklärung und zur Aufnahme von Meldungen verlorener Reisedokumente;
d.⁴¹¹: den von den Kantonen bezeichneten Behörden oder Stellen, zur Entgegennahme von Gesuchen um Ausstellung von Reisedokumenten;
e.⁴¹²: den von den Kantonen bezeichneten Behörden oder Stellen, zur Erfassung des Gesichtsbilds und der Fingerabdrücke.

⁶ Der Bundesrat erlässt die Ausführungsbestimmungen.

Art. 111 Information systems for travel documents

¹ SEM shall maintain an information system for the issue of Swiss travel documents and return visas to foreign nationals (the ISR) in accordance with Article 59.⁴⁰⁶

² The ISR shall contain the following data:

a.⁴⁰⁷: the surname, first name, sex, date of birth, place of birth, nationality, address, height, facial image, name and first name of parents, surnames of parents at birth, signature, file number and personal number;
b.: information on the application, such as the date of receipt of application and decision on the application;
c.: information on the travel document, such as the date of issue and term of validity;
d.: the signatures and names of the statutory representative in the case of travel documents issued to minors or incapacitated persons;
e.: combined surnames, religious names or pseudonyms as well as information on special characteristics such as disabilities, prostheses or implants provided the applicant requests that the travel document contain this information;
f.: information on lost travel documents.

³ To check whether an alert has been issued in respect of the applicant due to a felony or a misdemeanour, the RIPOL computerised search system automatically conducts a search.⁴⁰⁸

⁴ The data collected in accordance with paragraph 2 shall be processed by employees of SEM who deal with issuing Swiss travel documents and return visas.⁴⁰⁹

⁵ SEM may make the data that it has collected in accordance with paragraph 2 accessible to the following authorities or offices through a retrieval process, insofar as they need the data for the fulfilment of their duties:⁴¹⁰

a.: the office responsible for issuing travel documents;
b.: the border posts of the cantonal police authorities and the Border Guard, in order to carry out checks on persons;
c.: the police stations designated by the cantons to carry out checks on persons and to record reports of lost travel documents;
d.⁴¹¹: the authorities or agencies appointed by the cantons to accept applications for the issue of travel documents;
e.⁴¹²: the authorities or agencies appointed by the cantons to take portrait photographs or fingerprints
