Art. 95 Termin e furma dal recurs

1 I po vegnir fatg in recurs en scrit tar l’autoritad da recurs entaifer 30 dis dapi l’entrada dal rapport tenor l’artitgel 93 alinea 3. Il rapport dal post da mediaziun sto vegnir agiuntà al recurs.

2 Il DATEC inoltrescha ses recurs directamain a l’autoritad da recurs entaifer 30 dis suenter la diffusiun da l’emissiun respectiva.

3 Il recurs sto inditgar curtamain:

a.
en tge reguard che la publicaziun redacziunala contestada ha violà las disposiziuns davart il cuntegn tenor ils artitgels 4, 5 e 5a u il dretg internaziunal liant per ils emetturs da programs svizzers; u
b.
quant enavant che la refusa da l’access (art. 91 al. 3 lit. b) cuntrafa al dretg.103

Art. 95 Time limit and form of the complaint

1 Within 30 days of receipt of the report in accordance with Article 93 paragraph 3, a complaint may be submitted in writing with the Complaints Authority. The ombudsman service’s report must be attached.

2 DETEC submits its complaint directly to the Complaints Authority within 30 days of the transmission of the programme concerned.

3 In the complaint, a brief statement of grounds must be provided explaining:

a.
how the editorial publication which is the subject of the complaint has violated provisions concerning content in Articles 4, 5 and 5a of this Act or of international law binding on Swiss broadcasters; or
b.
why the refusal to grant access is unlawful.103
