Art. 25 Concessiun

1 Il Cussegl federal dat a la SSR ina concessiun.

a.
il dumber ed il gener dals programs da radio e televisiun;

la dimensiun da l’ulteriura purschida publicistica ch’è necessaria per ademplir l’incumbensa da program sin plaun da las regiuns linguisticas, sin plaun naziunal e sin plaun internaziunal e che vegn finanziada tras las taxas da radio e televisiun;
c.
ils detagls per resguardar la producziun d’ovras litteraras, musicalas e cinematograficas svizras tenor l’artitgel 24 alinea 4 litera b; ella po prescriver quotas minimalas correspundentas.

4 La SSR po porscher singuls programs en collavuraziun cun auters emetturs. La collavuraziun vegn reglada en contracts che ston vegnir approvads dal Departament federal per ambient, traffic, energia e communicaziun (DATEC).33

5 Il DATEC34 po midar singulas disposiziuns da la concessiun avant ch’ellas scadan, sche las relaziuns effectivas u giuridicas èn sa midadas e sche la midada è necessaria per mantegnair interess impurtants. A la SSR vegn pajada ina indemnisaziun commensurada.

6 Il DATEC po restrenscher u suspender per part la concessiun da la SSR, sche:

a.
l’autoritad da surveglianza tenor l’artitgel 89 ha fatg ina dumonda respectiva;
b.
la SSR ha violà repetidamain u grevamain sias obligaziuns concernent las finanzas e concernent il rendaquint (art. 35 e 36).

Art. 25 Licence

1 The Federal Council awards the SRG SSR a licence.

2 A public consultation is held before the award of the licence or before changes to the licence with consequences for media policy.

3 The licence determines in particular:

a.
the number and nature of radio and television programme services;
b.
the scope of the further editorial programming which is necessary to fulfil the programme service mandate at the level of the linguistic region, as well as at national and international level and which is financed from radio and television fees;
c.
the details of the inclusion of Swiss literature, music and film in accordance with Article 24 paragraph 4 letter b; it may set down corresponding minimum quotas.

4 The SRG SSR may offer certain programme services in cooperation with other broadcasters. The cooperation is regulated in agreements which require the consent of the Federal Department of the Environment, Transport, Energy and Communications (DETEC).33

5 DETEC34 may amend individual provisions of the licence before its term expires if the actual or legal conditions have changed and the amendment is necessary to safeguard important interests. The SRG SSR will be paid appropriate compensation.

6 DETEC may restrict the SRG SSR’s licence or partially suspend it if:

a.
the supervisory authority has made an application in accordance with Article 89;
b.
the SRG SSR has repeatedly or seriously violated its obligations regarding financial management and accounting (Art. 35 and 36).
