Art. 40

1 A la surveglianza da la Confederaziun èn suttamess:

a.
la gestiun dals dretgs exclusivs per l’inscenaziun e per l’emissiun d’ovras da musica betg teatralas e per la producziun da portatuns u da videos da talas ovras;
abis.46
il far valair dretgs exclusivs tenor ils artitgels 22, 22a–22c e 24b;
b.47
il far valair ils dretgs da bunificaziun tenor ils artitgels 13, 13a, 20, 24c, 35 e 35a.

2 Il Cussegl federal po suttametter ulteriurs secturs da gestiun a la surveglianza da la Confederaziun, sche l’interess public pretenda quai.

3 La gestiun persunala dals dretgs exclusivs tenor l’alinea 1 litera a tras l’autur u tras ses ertavels n’è betg suttamessa a la surveglianza da la Confederaziun.

Art. 40

1 The following are subject to federal supervision:

a.
the management of exclusive rights for the performance and broadcasting of non-theatrical works of music and the production of phonograms and audio-visual fixations of such works;
abis.46
the assertion of exclusive rights under Articles 22, 22a–22c and 24b;
b.47
the assertion of rights to remuneration provided for in this Act under Articles 13, 13a, 20, 24c, 35 and 35a.

2 The Federal Council may subject other areas of collective rights management to federal supervision if public interest so requires.

3 The personal exploitation of exclusive rights under paragraph 1 letter a by the author or his heirs is not subject to federal supervision.
