142.20 Federal Act of 16 December 2005 on Foreign Nationals (FNA)

Art. 43 Conjugals ed uffants da persunas cun ina permissiun da domicil

1 Conjugals esters ed uffants nubils sut 18 onns da persunas cun ina permissiun da domicil han il dretg da survegnir e da pudair prolungar la permissiun da dimora, sche:

a.
els abiteschan ensemen cun talas persunas;
b.
igl è avant maun in’abitaziun che correspunda als basegns;
c.
els n’èn betg dependents da l’agid social;
d.
els san communitgar en la lingua naziunala discurrida al lieu da domicil; e
e.
la persuna che vegn reunida na retira betg prestaziuns supplementaras annualas tenor la Lescha federala dals 6 d’october 200663 davart las prestaziuns supplementaras tar l’assicuranza per vegls, survivents ed invaliditad (LPS) u na pudess er betg retrair talas prestaziuns en consequenza da la reuniun da la famiglia.

2 Per la concessiun da la permissiun da dimora basta – empè da la premissa tenor l’alinea 1 litera d – l’annunzia ad ina purschida da promoziun linguistica.

3 La premissa tenor l’alinea 1 litera d na vegn betg applitgada per uffants nubils sut 18 onns.

4 La permissiun da dimora po vegnir concedida e prolungada sut la cundiziun ch’i vegnia concludida ina cunvegna d’integraziun, sch’igl è avant maun in basegn d’integraziun spezial tenor ils criteris da l’artitgel 58a.

5 Suenter ina dimora ordinaria e nuninterrutta da 5 onns han ils conjugals il dretg da survegnir la permissiun da domicil, sch’ils criteris d’integraziun da l’artitgel 58a èn ademplids.

6 Uffants sut 12 onns han il dretg da survegnir la permissiun da domicil.

Art. 43 Spouses and children of persons with a settlement permit

1 The foreign spouse and unmarried children under 18 of a person with a settlement permit are entitled to be granted a residence permit and to have their residence permit extended provided:

a.
they live with that person;
b.
suitable accommodation is available;
c.
they do not depend on social assistance;
d.
they are able to communicate in the national language spoken at their place of residence; and
e.
the family member they are joining is not claiming supplementary benefits under the Federal Act of 6 October 200663 on Benefits supplementary to the Old Age, Survivors’ and Invalidity Insurance (SBA) or would not be entitled to claim such benefits due to family reunification.

2 In order to obtain a residence permit, it is sufficient to register for a language support programme as an alternative to meeting the requirement set out in paragraph 1 letter d.

3 In the case of unmarried children under the age of 18, the requirement in paragraph 1 letter d does not apply.

4 The granting and extension of the residence permit may be linked to the conclusion of an integration agreement if there is a special need for integration in accordance with the criteria set out in Article 58a.

5 After a law-abiding and uninterrupted period of stay of five years, spouses are entitled to be granted a settlement permit if the integration criteria set out in Article 58a are met.

6 Children under twelve are entitled to be granted a settlement permit.
