1 Quando la contestazione riguarda il marchio d’artefice, l’Ufficio centrale fa un’inchiesta.
2 Se la contestazione risulta fondata e si constata una frode a’sensi dell’articolo 47 della legge, la merce è sequestrata ed è sporta querela penale.
3 Se la contestazione risulta fondata, senza che si possa ammettere una frode, l’Ufficio centrale infligge un’ammenda al richiedente e lo invita ad apporre sui lavori un marchio d’artefice regolamentare. A questo scopo si restituiscono al richiedente i lavori non marchiati.
1 If an objection is raised to the responsibility mark, the Central Office shall conduct an investigation.
2 If the objection is found to be justified and if an offence has been committed in accordance with Article 47 of the Act, the article shall be seized and a criminal complaint filed.
3 If it cannot be assumed that an offence has been committed, despite the objection to the responsibility mark, the Central Office shall impose a fixed penalty on the applicant and order him to affix the correct responsibility mark. The article shall be returned to the applicant unstamped for this purpose.
