Art. 38 Rapporto sul risanamento

1 Per ogni prelievo d’acqua incluso nell’inventario secondo l’articolo 36 capoversi 1 e 2, il rapporto (art. 82 cpv. 2 LPAc) indica se debba essere eseguito un risanamento del corso d’acqua e, in caso affermativo, ne specifica la portata, i motivi e entro quando esso debba presumibilmente essere realizzato.

2 Per ogni prelievo d’acqua, nel rapporto figurano in particolare:

a.
la descrizione del prelievo e della restituzione di acqua (nomi, coordinate, altezza s.l.m., eventualmente nome della centrale e dell’impianto di sbarramento)
b.
la portata Q347;
c.
indicazioni sul regime del corso d’acqua a monte del prelievo e nel tratto con deflusso residuale;
d.
la quantità d’acqua, in m3/s, prelevata dal corso d’acqua ogni mese, calcolata come media di più anni.

3 Per i prelievi d’acqua per i quali è necessario un risanamento, il rapporto indica inoltre:

a.
le misure di risanamento che possono essere ordinate senza che ne risulti un pregiudizio ai diritti di sfruttamento delle acque tale da giustificare il versamento di un’indennità (art. 80 cpv. 1 LPAc);
b.
le ulteriori misure di risanamento dettate da interessi pubblici preponderanti (art. 80 cpv. 2 LPAc); per i corsi d’acqua che attraversano paesaggi o biotopi inclusi in un inventario nazionale o cantonale, il rapporto menziona le esigenze speciali relative al corso d’acqua che risultano dalla descrizione dello scopo della protezione nell’inventario;
c.
il genere delle misure di risanamento (maggiore portata di dotazione, lavori di sistemazione, misure concernenti l’esercizio, altre misure);
d.
i termini previsti per l’esecuzione del risanamento.

Art. 38 Remediation report

1 For every withdrawal of water listed in the inventory under Article 36 paragraphs 1 and 2, the remediation report (Art. 82 para. 2 WPA) shall indicate whether the watercourse requires remediation; if this is the case, the report indicates the reasons for such remediation, its extent and the period of time forecast to implement it.

2 For every water withdrawal, the report contains in particular:

a.
the description of the water withdrawal and return (names, co-ordinates, height above sea level and, where appropriate, names of any power stations or dams);
b.
the rate of Q347 flow;
c.
data relating to the flow regime of the watercourse upstream of the water withdrawal point and in the stretch of residual water flow;
d.
the amount withdrawn every month in m3/s expressed as the average over several years.

3 For water withdrawals where remediation is necessary, the report shall also contain information on:

a.
remediation measures which may be imposed without infringing rights of use which justify a claim for compensation by the user (Art. 80 para. 1 WPA);
b.
more extensive remediation measures which are necessary because of overriding public interests (Art. 80 para. 2 WPA); for watercourses flowing through landscapes or habitats which are listed in national or cantonal inventories, the report shall name the special requirements for the watercourse arising from the protection targets defined in the inventory;
c.
type of remediation measures (higher levels of water endowment, structural, operational and other measures);
d.
the expected schedule for completion of the remediation measures.
