1 Per prelievi da corsi d’acqua (art. 29 LPAc) che presentano tratti con deflusso permanente e tratti senza deflusso permanente è necessaria un’autorizzazione se il corso d’acqua, nel luogo del prelievo, presenta un deflusso permanente. Le condizioni per il rilascio dell’autorizzazione (art. 30 LPAc) devono essere soddisfatte solo nei tratti con deflusso permanente.
2 Se il corso d’acqua non presenta un deflusso permanente nel luogo del prelievo, l’autorità provvede affinché vengano adottate le misure necessarie in base alla legge federale del 1° luglio 196642 sulla protezione della natura e del paesaggio e alla legge federale del 21 giugno 199143 sulla pesca.
1 For withdrawals from watercourses (Art. 29 WPA) which comprise stretches with permanent flow and others without permanent flow, a permit is required if the site of the water withdrawal shows permanent flow. The conditions for granting the permit must be fulfilled only in the stretches with a permanent flow (Art. 30 WPA).
2 If the waters at the site of water withdrawal shows no permanent flow, the authorities shall ensure that the required measures under Federal Act of 1 July 196640 on the Protection of Nature and Cultural Heritage and the Federal Act of 21 July 199141 on Fish and Fisheries are taken.
