1 Se la protezione della salute lo esige, il Consiglio federale può stabilire limitazioni e divieti all’importazione e all’esportazione di determinati dispositivi medici.
2 Se un altro Stato richiede certificati d’esportazione e attestati per dispositivi medici che devono essere importati, l’Istituto può, su richiesta, rilasciare detti documenti al fabbricante o al mandatario con sede in Svizzera.119
3 Chi esporta un dispositivo medico in uno Stato con il quale la Svizzera ha concluso una convenzione di diritto internazionale sul reciproco riconoscimento di valutazioni e procedure di conformità per dispositivi medici, deve poter provare che i requisiti fondamentali secondo l’articolo 45 capoverso 2 sono adempiuti.120

2 If another state requests export certificates and attestations for medical devices which are to be imported, the Agency may, on request, issue these documents to the manufacturer or to the authorised representative with a registered office in Switzerland.116
3 Anyone exporting a medical device to a state with which Switzerland has concluded an agreement under international law for the mutual recognition of conformity assessments and procedures for medical devices must be able to demonstrate that the fundamental requirements referred to in Article 45 paragraph 2 are fulfilled.117
