1 Chi rende verosimile che uno scambio di dati personali che lo concernono potrebbe violare le disposizioni sulla protezione dei dati personali può chiedere all’Incaricato di aprire un’inchiesta ai sensi dell’articolo 22 LPDS459.
2 Un’inchiesta può essere aperta unicamente nei confronti di un’autorità federale soggetta alla sorveglianza dell’Incaricato.
3 L’interessato e l’autorità federale nei confronti della quale è stata aperta un’inchiesta hanno qualità di parte.
4 Per il rimanente sono applicabili gli articoli 23 e 24 LPDS.
458 Introdotto dal n. II 2 della LF del 28 set. 2018 che attua la direttiva (UE) 2016/680 relativa alla protezione delle persone fisiche con riguardo al trattamento dei dati personali a fini di prevenzione, indagine, accertamento e perseguimento di reati o esecuzione di sanzioni penali, in vigore dal 1° mar. 2019 (RU 2019 625; FF 2017 5939).
1 If a data subject credibly demonstrates that an exchange of personal data concerning him or her could violate the provisions on the protection of personal data, he or she may request the Commissioner to open an investigation pursuant to Article 22 SADP456.
