1 Il superiore che sa che una persona a lui subordinata commette o si accinge a commettere un reato previsto dal titolo dodicesimobis o dodicesimoter, e che non adotta misure adeguate per impedirne l’esecuzione, è punito con la stessa pena applicabile all’autore. Se il superiore ha agito per negligenza, è punito con una pena detentiva sino a tre anni o con una pena pecuniaria.
2 Il superiore che sa che una persona a lui subordinata ha commesso un reato previsto dal titolo dodicesimobis o dodicesimoter e che non adotta misure adeguate per garantire che il reato venga sanzionato, è punito con una pena detentiva sino a tre anni o con una pena pecuniaria.
1 A superior who is aware that a subordinate is carrying out or will carry out an act under the Title Twelvebis or Title Twelveter and who fails to take appropriate measures to prevent the act shall be liable to the same penalty as the perpetrator of the act. If the superior fails to prevent the act through negligence, the penalty is a custodial sentence not exceeding three years or a monetary penalty.
2 A superior who is aware that a subordinate has carried out an act under Title Twelvebis or Title Twelveter and who fails to take appropriate measures to ensure the prosecution of the perpetrator of the act shall be liable to a custodial sentence not exceeding three years or a monetary penalty.
