1 Chiunque fabbrica materie esplosive o gas velenosi, sapendo o dovendo presumere che sono destinati ad uso delittuoso, è punito con una pena detentiva da sei mesi a dieci anni.258
2 Chiunque si procura, consegna ad altri, riceve da altri, custodisce, nasconde o trasporta materie esplosive, gas velenosi o sostanze destinate alla loro fabbricazione, è punito, se sa o deve presumere che sono destinati ad uso delittuoso, con una pena detentiva sino a cinque anni o con una pena pecuniaria non inferiore a 30 aliquote giornaliere259.
3 Chiunque, sapendo o dovendo presumere che taluno si propone di fare uso delittuoso di materie esplosive o di gas velenosi, gli dà istruzioni per la loro fabbricazione, è punito con una pena detentiva sino a cinque anni o con una pena pecuniaria non inferiore a 30 aliquote giornaliere.

1 Any person who manufactures explosives or toxic gases that he knows or must assume are intended to be used to commit a felony shall be liable to a custodial sentence of at least six months and no more than ten years.257
2 Any person who procures, passes on to another, accepts from another, safeguards, conceals or transports explosives, toxic gases or substances suitable for their manufacture shall be liable, if he knows or must assume that they are intended to be used to commit a felony, to a custodial sentence not exceeding five years or to a monetary penalty of not less than 30 daily penalty units258.
3 Any person who instructs another person on how to manufacture explosives or toxic gases when he knows or must assume that that person is planning to use the explosives or toxic gases to commit a felony shall be liable to a custodial sentence not exceeding five years or to a monetary penalty of not less than 30 daily penalty units.
