1 Non è punibile colui che al momento del fatto non era capace di valutarne il carattere illecito o di agire secondo tale valutazione.
2 Se al momento del fatto l’autore era soltanto in parte capace di valutarne il carattere illecito o di agire secondo tale valutazione, il giudice attenua la pena.
3 Possono tuttavia essere disposte le misure previste negli articoli 59–61, 63, 64, 67, 67b e 67e.14
4 I capoversi 1–3 non sono applicabili se l’autore poteva evitare l’incapacità o la scemata imputabilità e prevedere così l’atto commesso in tale stato.

1 If the person concerned was unable at the time of the act to appreciate that his act was wrong or to act in accordance with this appreciation of the act, he is not liable to a penalty.
2 If the person concerned was only partially able at the time of the act to appreciate that his act was wrong or to act in accordance with this appreciation of the act, the court shall reduce the sentence.
