1 Chiunque, come offerente, intermediario o destinatario, fa commercio di un essere umano a scopo di sfruttamento sessuale, di sfruttamento del suo lavoro o di prelievo di un suo organo, è punito con una pena detentiva o con una pena pecuniaria. Il reclutamento di un essere umano per i medesimi scopi è parificato alla tratta.

3 In ogni caso è pronunciata anche una pena pecuniaria.

225 Nuovo testo giusta l’art. 2 n. 1 del DF del 24 mar. 2006 che approva e traspone nel diritto svizzero il Prot. facoltativo del 25 mag. 2000 alla Conv. sui diritti del fanciullo concernente la vendita di fanciulli, la prostituzione infantile e la pedopornografia, in vigore dal 1° dic. 2006 (RU 2006 5437; FF 2005 2513).
1 Any person who as a supplier, intermediary or customer engages in the trafficking of a human being for the purpose of sexual exploitation, exploitation of his or her labour or for the purpose of removing an organ shall be liable to a custodial sentence or to a monetary penalty. The soliciting of a person for these purposes is equivalent to trafficking.
2 If the victim is a minor224 or if the offender acts for commercial gain, the penalty is a custodial sentence of not less than one year.
3 In every case, a monetary penalty must also be imposed.
