1. Il debitore che, in danno dei suoi creditori, diminuisce il proprio attivo in quanto
deteriora, distrugge, svaluta o rende inservibili valori patrimoniali, aliena gratuitamente o contro una prestazione manifestamente inferiore valori patrimoniali,
rifiuta senza validi motivi diritti che gli spettano o rinuncia gratuitamente a tali diritti,
è punito, se viene dichiarato il suo fallimento o se viene rilasciato contro di lui un attestato di carenza di beni, con una pena detentiva sino a cinque anni o con una pena pecuniaria.
2. Nelle stesse condizioni, è punito con una pena detentiva sino a tre anni o con una pena pecuniaria il terzo che compie tali atti in danno dei creditori.
