1 Gli arbitri sono nominati secondo quanto pattuito fra le parti.
2 Se tale pattuizione manca, ciascuna parte designa un numero uguale di arbitri; questi, a voto unanime, eleggono un presidente.
3 Se un arbitro è designato per funzione, si reputa designato il titolare della stessa al momento dell’accettazione del mandato arbitrale.
4 Per le controversie in materia di locazione o affitto di locali d’abitazione, le parti possono designare quale tribunale arbitrale unicamente l’autorità di conciliazione.
1 If the arbitration agreement provides no other body for the appointment, or if such body does not appoint the members within a reasonable time, the ordinary court competent under Article 356 paragraph 2 shall proceed with the appointment at the request of one of the parties if:
