Art. 308 Appellabilità

¹ Sono impugnabili mediante appello:

a.: le decisioni finali e incidentali di prima istanza;
b.: le decisioni di prima istanza in materia di provvedimenti cautelari.

² Le decisioni pronunciate in controversie patrimoniali sono appellabili unicamente se il valore litigioso secondo l’ultima conclusione riconosciuta nella decisione è di almeno 10 000 franchi.

Art. 309 Exceptions

An appeal is not admissible:

a.

against decisions of the enforcement court;

b.

in the following matters under the DEBA¹⁵⁴:

1.: revocation of the stay of enforcement (Art. 57d DEBA),
2.: admission of a time-barred objection (Art. 77 para. 3 DEBA),
3.: clearance to proceed (Art. 80–84 DEBA),
4.: revocation or suspension of the debt enforcement proceedings (Art. 85 DEBA),
5.: admission of the objection in the collection of bills of exchange (Art. 181 DEBA),
6.¹⁵⁵: attachment (Art. 272 and 278 DEBA);
7.¹⁵⁶: decisions falling under the jurisdiction of the bankruptcy or composition court under the DEBA.
