Art. 171 Forma dell’esame testimoniale

1 Prima dell’audizione il testimone è esortato a dire la verità; se ha già compiuto i 14 anni, è inoltre reso attento alle conseguenze penali della falsa testimonianza (art. 307 CP64).

2 Il giudice esamina ogni testimone singolarmente, senza la presenza degli altri; è fatta salva la procedura del confronto.

3 Il testimone si esprime liberamente; il giudice può autorizzarlo a far uso di note scritte.

4 Il giudice non consente al testimone di presenziare ad altre udienze fintanto che non lo ritenga pienamente escusso.

Art. 172 Content of statement

The court shall ask witnesses:

a.
to state their particulars;
b.
to describe their personal relationship with the parties and other circumstances that may be relevant to the credibility of their testimony;
c.
to state the facts of the case as they have observed them.
