1 Il diritto al rilascio del brevetto spetta all’inventore, al suo avente causa o al terzo cui l’invenzione appartiene per altri titoli.
2 Se più persone hanno fatto un’invenzione insieme, il diritto spetta loro in comune.
3 Se la stessa invenzione è stata fatta da più persone indipendentemente l’una dall’altra, il diritto al rilascio del brevetto spetta a colui che può invocare un deposito anteriore, ovvero un deposito che fruisce di una priorità anteriore.
1 The inventor, his successor in title, or a third party owning the invention under any other title has the right to the grant of the patent.
2 Where several inventors have made an invention jointly, they have this right jointly.
3 Where two or more inventors have made the invention independently of each other, the person who makes the earlier application or whose application has the earliest priority date has this right.
