Qualora l’inventore o il suo avente causa ottengano, per la medesima invenzione, due brevetti validi con la stessa data di deposito o di priorità, il brevetto basato sulla domanda depositata per prima non è più efficace nella misura in cui i limiti della protezione conferita dai due brevetti siano gli stessi.

Where an inventor or his successor in title has obtained two patents with the same filing date or priority date for the same invention, the effects of the patent based on the earlier application cease insofar as the scope of protection afforded by the two patents is the same.
