1 I crediti, che il mandatario abbia acquistato verso i terzi in nome proprio per conto del mandante, passano al mandante stesso tostoché questi abbia dal canto suo adempiuto a tutte le obbligazioni derivanti dal mandato.
2 Ciò vale anche di fronte alla massa, se il mandatario sia caduto in fallimento.
3 Parimente il mandante può rivendicare, nel caso di fallimento del mandatario, le cose mobili di cui questi acquistò la proprietà in nome proprio, ma per conto del mandante, riservati i diritti di ritenzione del mandatario, che competono alla massa.
1 Where the mandatee acting on the mandator’s behalf acquires claims in his own name against third parties, such claims pass to the mandator provided he has fulfilled all his obligations towards the mandatee under the mandate relationship.
2 The same applies in relation to the mandatee’s assets if the mandatee is bankrupt.
3 Similarly, where the mandatee is bankrupt, the mandator may claim chattels of which the mandatee took possession in his own name but on the mandator’s behalf, subject to the mandatee’s own rights of lien.
