1 Nell’ambito delle sue competenze, la Confederazione provvede all’utilizzazione parsimoniosa e alla protezione delle risorse idriche nonché alla difesa dagli effetti dannosi delle acque.
2 Emana principi sulla conservazione e lo sfruttamento delle riserve idriche, sull’utilizzazione delle acque a scopi di produzione energetica e di raffreddamento e su altri interventi nel ciclo idrologico.
3 Emana prescrizioni sulla protezione delle acque, sulla garanzia di adeguati deflussi minimi, sulle opere idrauliche, sulla sicurezza dei bacini di accumulazione e sul modo di influire sulle precipitazioni atmosferiche.
4 I Cantoni dispongono delle risorse idriche. Entro i limiti della legislazione federale possono riscuotere canoni per l’utilizzazione delle acque. La Confederazione ha il diritto di utilizzare le acque per le sue aziende di trasporto; in corrispettivo versa un canone e un’indennità.
5 Per quanto riguarda i diritti e i canoni relativi a risorse idriche internazionali, la Confederazione decide d’intesa con i Cantoni interessati. Decide pure nel caso in cui i Cantoni non riescano ad accordarsi in merito ai diritti concernenti riserve idriche intercantonali.
6 Nell’adempimento dei suoi compiti, la Confederazione prende in considerazione gli interessi dei Cantoni da cui le acque provengono.
1 The Confederation shall within the scope of its powers ensure the economic use and the protection of water resources and provide protection against the harmful effects of water.
2 It shall lay down principles on the conservation and exploitation of water resources, the use of water for the production of energy and for cooling purposes, as well as on other measures affecting the water-cycle.
3 It shall legislate on water protection, on ensuring appropriate residual flow, on hydraulic engineering and the safety of dams, and on measures that influence precipitation.
4 The Cantons shall manage their water resources. They may levy charges for the use of water, subject to the limits imposed by federal legislation. The Confederation has the right to use water for its transport operations subject to payment of a charge and compensation.
5 The Confederation, in consultation with the Cantons concerned, shall decide on rights to international water resources and the charges for them. If Cantons are unable to agree on rights to intercantonal water resources, the Confederation shall decide.
6 The Confederation shall take account of the concerns of the Cantons where the water originates in fulfilling its duties.
