Art. 73 Motivi d’esclusione

La protezione provvisoria non è accordata se la persona bisognosa di protezione:

a.: adempie una delle fattispecie di cui all’articolo 53;
b.: ha attentato all’ordine o alla sicurezza pubblici oppure li compromette gravemente; o
c.: è oggetto di una decisione d’espulsione ai sensi dell’articolo 66a o 66a^bis CP¹⁸⁸ o dell’articolo 49a o 49a^bis CPM¹⁸⁹ passata in giudicato.

Art. 73 Ausschlussgründe

Vorübergehender Schutz wird nicht gewährt, wenn die schutzbedürftige Person:

a.: einen Tatbestand nach Artikel 53 erfüllt hat;
b.: die öffentliche Sicherheit und Ordnung verletzt hat oder in schwerwiegender Weise gefährdet hat; oder
c.: mit einer rechtskräftigen Landesverweisung nach Artikel 66a oder 66a^bis StGB¹⁸⁸ oder Artikel 49a oder 49a^bis MStG¹⁸⁹ belegt ist.
